HyperBrick Terms of Use & Risk Disclosure

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE USING THE HYPERBRICK PROTOCOL. BY INTERACTING WITH HYPERBRICK, YOU AGREE TO BE BOUND BY THESE TERMS AND ACCEPT ALL ASSOCIATED RISKS.


1. INTRODUCTION

1.1 These Terms of Use & Risk Disclosure (“Terms”) govern your access to and use of the HyperBrick decentralized protocol (“Protocol”) deployed on the Hyperliquid EVM blockchain.

1.2 HyperBrick is a permissionless, non-custodial decentralized finance (DeFi) application. There is no centralized operator; users interact directly with smart contracts.


2. ELIGIBILITY

2.1 By using the Protocol, you represent and warrant that:

  • You are at least 18 years old or of legal age in your jurisdiction;

  • You have full legal capacity to agree to these Terms;

  • You are not a citizen or resident of a jurisdiction where DeFi usage is restricted or prohibited;

  • You are not subject to economic sanctions by any relevant authority.


3. PROTOCOL USE AT YOUR OWN RISK

3.1 HyperBrick is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied.

3.2 No centralized party controls the protocol or holds your assets. You bear full responsibility for your actions, transactions, and wallet management.

3.3 The protocol may be accessed through a public interface or directly via smart contract interaction. All interactions carry risk.


4. SMART CONTRACT & TECHNICAL RISKS

4.1 HyperBrick is a fork of LFJ's audited Liquidity Book architecture. However, smart contracts are inherently subject to:

  • Bugs or vulnerabilities;

  • Front-running, MEV, or oracle manipulation;

  • Blockchain reorgs or performance issues;

  • Losses due to incorrect contract interactions or malicious approvals.

4.2 You should review and understand contract behavior before interacting with the protocol.


5. FINANCIAL & MARKET RISKS

5.1 DeFi usage includes significant financial risks, including:

  • Impermanent loss from liquidity provision;

  • Token price volatility and slippage;

  • Partial or total loss of funds due to market crashes;

  • Reward or incentive structures subject to change or discontinuation.

5.2 You agree not to use funds you cannot afford to lose and acknowledge full responsibility for your financial decisions.


6. NO FINANCIAL OR INVESTMENT ADVICE

6.1 HyperBrick does not provide financial, legal, or tax advice. Information on the interface or docs is for informational purposes only.

6.2 Users must conduct their own research and consult licensed professionals before participating in DeFi activities.


7. HYPERBRICK POINTS (HB POINTS)

7.1 HB Points are an internal mechanism for tracking engagement in trading and liquidity provision.

7.2 HB Points:

  • Are not tokens, financial instruments, or transferable assets;

  • May or may not have future use;

  • Do not entitle the holder to revenue, token allocation, governance, or legal claims.

7.3 The HB Point system is subject to change at the discretion of the HyperBrick team, without notice.


8.1 You are solely responsible for complying with the laws applicable in your jurisdiction.

8.2 You represent and warrant that you are not:

  • A resident of a restricted country;

  • On any government sanctions list;

  • Using the Protocol in violation of any applicable laws.

8.3 The Protocol is not a financial product or service, and nothing in the docs or site constitutes an offering or solicitation.


9. LIMITATION OF LIABILITY

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HYPERBRICK TEAM, CONTRIBUTORS, AND DEVELOPERS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES;

  • LOSS OF FUNDS, DATA, OR BUSINESS;

  • DAMAGES RESULTING FROM SMART CONTRACT FAILURE OR USER ERROR.

9.2 You agree to indemnify and hold harmless the HyperBrick contributors from any claims, liabilities, or losses related to your use of the Protocol.


10. MODIFICATIONS TO TERMS

10.1 These Terms may be updated at any time without prior notice. Continued use of the Protocol after changes constitutes acceptance.
